The discovery coaching & consulting session, assessments and the like, are for informational and/or coaching & consulting purposes only. It is not intended to diagnose, treat, or prevent any mental health, medical, or psychological condition. Participation in these activities and engagements are voluntary, and by booking & the sessions and/or completing the forms to the assessments, you acknowledge that you are engaging at your own discretion and understand that no guarantees or clinical services are being provided.
Applicable law
By visiting this website, you agree that the Federal, State, Local and International laws of the, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between UnEarthed Coaching & Consulting LLC dba Internal Garden Coaching & Leadership Solutions and you, or its business partners and associates.
Disputes
If any dispute arises under this Agreement, UnEarthed Coaching & Consulting, LLC, d/b/a Internal Garden and the User or Client shall negotiate in good faith to settle such dispute. If the parties cannot resolve such disputes themselves, then either party may submit the dispute to mediation by a mediator approved by both parties. If the parties cannot agree with any mediator or if either party does not wish to abide by any decision of the mediator, they shall submit the dispute to arbitration by any mutually acceptable arbitrator, or the American Arbitration Association (AAA). The costs of the arbitration proceeding shall be borne according to the decision of the arbitrator, who may apportion costs equally or in accordance with any finding of fault or lack of good faith of either party. If either party does not wish to abide by any decision of the arbitrator, they shall submit the dispute to litigation. The jurisdiction for any dispute shall be administered in St. Joseph County, State of Indiana.
Indemnification
You agree to indemnify UnEarthed Coaching & Consulting LLC dba Internal Garden Coaching & Leadership Solutions and its affiliates and hold UnEarthed Coaching & Consulting LLC dba Internal Garden Coaching & Leadership Solutions harmless against legal claims and demands that may arise from your use or misuse of our services. We reserve the right to select our own legal counsel.
Limitation on liability
UnEarthed Coaching & Consulting LLC dba Internal Garden Coaching & Leadership Solutions is not liable for any damages that may occur to you as a result of your misuse of our website.
